Terms and Conditions of Sale

These Terms and Conditions of Sale (“Terms”) apply to all purchases made through www.thecollectiveintelligencecatalyst.com (“Website”).

By placing an order on the Website, you agree to be bound by these Terms.

  1. Scope

These Terms apply to all sales of physical books and digital books (eBooks) made through the Website.

Mandatory consumer protection laws applicable in your country of residence remain unaffected.

    2.1 Physical Books
  • Subject to availability
  • Covers, editions, and descriptions may differ slightly
  • We may supply newer editions where applicable

    2.2 eBooks (Digital Content)

  • eBooks are provided in the digital format(s) specified on the Website
  • eBooks are for personal, non-commercial use only
  • Access or download instructions are provided after payment

We reserve the right to update or modify digital content to ensure functionality or legal compliance.

  1. Prices and Taxes

Prices are displayed in EUR.

  • Switzerland: Prices include Swiss VAT (MWST) where applicable
  • EU & UK:
  • Physical books: VAT included where applicable
  • eBooks: VAT applied based on customer location (EU VAT rules for digital services)
  • US: Prices exclude sales tax unless required by law

Any shipping costs, customs duties, or import taxes for physical books are shown during checkout and borne by the customer unless stated otherwise.

  1. Orders and Contract Formation

A contract is concluded only once you receive an order confirmation email.

For eBooks, the contract is deemed fulfilled once access or download is provided.

We reserve the right to cancel orders due to:

  • Errors in pricing or description
  • Product unavailability
  • Suspected fraud or misuse

Any payment received will be refunded if an order is cancelled.

  1. Payment

Payment methods are shown during checkout.
 Payments are processed securely via third-party providers.
 We do not store payment card details.

  1. Delivery
    6.1 Physical Books
  • Delivery times are estimates only
  • Risk of loss passes to the customer upon delivery
  • We are not responsible for courier or customs delays

    6.2 eBooks

  • Delivered electronically (download or online access)
  • Delivery will take three business days but may be delayed for technical reasons
  • No physical shipment applies
  1. Right of Withdrawal / Returns
    7.1 Physical Books – EU & UK Customers
    Under EU Directive 2011/83/EU and UK Consumer Contracts Regulations 2013:
  • You may withdraw within 14 days of receiving the books
  • Books must be unused and resaleable
  • Refunds issued within 14 days of receiving the return

Return shipping costs are borne by the customer.
        7.2 eBooks – EU & UK Customers (Important)
By purchasing an eBook, you expressly agree to:

  • Immediate performance of the contract, and
  • The loss of your right of withdrawal once download or access begins

This complies with Article 16(m) of Directive 2011/83/EU and UK equivalent regulations.

       7.3 Swiss, US & UAE Customers

Swiss law and most US/UAE laws do not provide a mandatory cooling-off period.

  • Physical books: Returns only as per our Return Policy or if defective
  • eBooks: No returns or refunds once access or download is provided, unless required by law
 
  1. Defective or Non-Conforming Products
    Physical Books

If a book is defective or incorrectly delivered, please contact us promptly.

  • EU & UK: Remedies under consumer sale laws apply
  • Switzerland: Swiss Code of Obligations applies
  • US & UAE: Applicable consumer protection laws apply
    eBooks

If an eBook is technically defective or cannot be accessed:

  • We will provide a replacement file or fix access issues
  • Refunds apply only if the defect cannot be remedied
  1. License for eBooks

When you purchase an eBook, you receive a non-exclusive, non-transferable, personal license to use the eBook.

You may not:

  • Resell, share, or distribute the eBook
  • Upload it to public platforms
  • Use it for commercial purposes

All intellectual property rights remain with the book authors.

  1. Warranty Disclaimer (Where Permitted)

Except where prohibited by law:

  • Products are provided “as is”
  • No warranties beyond statutory guarantees are provided

Mandatory consumer rights remain unaffected.

  1. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect or consequential damages
  • Our total liability is limited to the price paid for the relevant product
  1. Intellectual Property

All Website content, book descriptions, previews, and digital files are protected by intellectual property laws.

Unauthorized use, copying, or distribution is prohibited.

  1. Personal Data and Privacy

We process personal data in accordance with our Privacy Policy and applicable laws, including:

  • Swiss Federal Act on Data Protection (FADP)
  • GDPR (EU & UK customers)
  • Applicable US and UAE data protection laws
  1. Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control.

Jurisdiction: Courts of Vaud, Switzerland

EU Customers

Governing law and courts of the consumer’s residence

UK Customers

Governing law: England and Wales
Jurisdiction: Courts of England and Wales
